Terms of Service

Welcome to Baja Organica. These Terms of Service ("Terms") are a contract between you and Baja Organica covering your use of bajaorganica.food, our ordering platform, and any food-delivery or office-stocking services we provide.
By using the site, submitting an inquiry, or placing an order with us, you agree to these Terms. If you don't agree, please don't use the site.
1. Who we are and who we serve
Baja Organica is a corporate food delivery service based in Los Angeles. We deliver Baja-style Mexican food to workplaces — typically creative agencies, studios, and similar teams. Our programs include daily lunch delivery, Fridge by Baja (office-stocked fridge), and Shelf by Baja (office-stocked pantry), collectively our "Stocked by Baja" offerings.
These Terms are written for business customers. You confirm that you are at least 18 years old and, if you're signing up on behalf of a company, that you have authority to do so.
2. Placing orders
Orders can be placed through our online ordering system, through an assigned account contact, or through our assistant Percy on the website.
When you place an order, you are making an offer to buy the items listed. We accept your offer when we confirm the order. We reserve the right to decline or cancel any order — for example, if the kitchen is closed, an item is out of stock, delivery isn't feasible, payment can't be authorized, or the order appears to be fraudulent. If we cancel after you've paid, we'll refund you.
All menu items, prices, and availability can change without notice. We'll honor the price shown at the time your order is confirmed.
3. Delivery
We deliver within our service area on the agreed schedule. We'll always do our best to deliver on time and at the correct temperature, but we can't guarantee a specific minute-to-minute delivery time. Traffic, weather, and the occasional kitchen hiccup happen.
If something goes wrong with your delivery — wrong item, missing item, quality issue, late arrival that affected your team — tell us within 24 hours and we'll make it right. That usually means a credit, a refund, or a redelivery, depending on the situation and what you'd prefer.
4. Food, allergens, and dietary notes
We label allergens to the best of our ability and we take dietary notes seriously. However:
- Our kitchen and our partner kitchens handle common allergens including dairy, eggs, wheat, soy, tree nuts, peanuts, fish, and shellfish. We cannot guarantee that any item is free from trace cross-contact.
- If any member of your team has a severe allergy (anaphylaxis) to any ingredient, please tell us clearly, in writing, before placing orders that include them. If we can't safely serve them, we'll say so.
- Menu descriptions may not list every ingredient. If you need to confirm what's in something, ask.
If someone on your team has a serious medical concern, consult a medical professional. Food at work is food at work — please use judgment.
5. Payment
We accept payment through Stripe. By placing an order, you authorize us to charge the payment method on file for the order total, applicable taxes, any delivery fees, and tips (if any). Chargebacks and disputes should be discussed with us first — we'd almost always rather make it right than argue.
Corporate accounts may be invoiced on agreed terms (weekly, monthly, or pre-pay per order). Invoices are due within the terms stated. We may pause service on accounts with overdue balances.
If a card declines or an ACH payment fails, we may retry the charge and will contact you.
6. Your account
If you sign up for an account, you are responsible for keeping your password confidential and for any activity that happens under your account. If you think your account has been compromised, tell us as soon as you can at hello@bajaorganica.food.
You agree to give us accurate contact, delivery, and billing information, and to keep it up to date.
7. Acceptable use
We ask that you not:
- Use the site to do anything illegal, harmful, or in violation of someone else's rights.
- Attempt to break, probe, scrape, reverse-engineer, or overload the site or our systems.
- Impersonate anyone, including our employees or representatives.
- Use our service to resell our food as your own product.
If you do any of this, we may suspend or terminate your account.
8. Intellectual property
The site — our text, logos, photography, menus, and branding — belongs to Baja Organica. You may share a link to a page, forward an email, or reference us normally in the course of using our service. You may not copy our content for commercial use without our written permission. Our logo and the names "Baja Organica," "Fridge by Baja," "Shelf by Baja," "Stocked by Baja," and "Percy" (in the context of our assistant) are ours.
If you send us feedback or suggestions, we're grateful, and you agree we can use that feedback to improve the service without owing you anything.
9. Third-party services
We rely on third parties including Stripe (payments), Resend (email), Supabase (database), Vercel (hosting), Inngest (background jobs), Mapbox (addresses), Upstash (caching), and Anthropic (AI-assisted features). Their terms and privacy policies apply to their portion of the service.
Links from our site to other websites are provided as a convenience. We don't control those sites and aren't responsible for their content or practices.
10. Disclaimer of warranties
We provide the site and service "as is" and "as available." We don't make promises that the service will always be uninterrupted, error-free, or meet your specific expectations. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including any warranties of merchantability, fitness for a particular purpose, and non-infringement — except any warranties that cannot be disclaimed under applicable law.
Our food is prepared fresh and perishable. Once delivered and left at the agreed drop-off point, it's on you to refrigerate or consume it within a reasonable window.
11. Limitation of liability
To the maximum extent permitted by law, Baja Organica (and our officers, employees, and affiliates) will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the site, the service, or your orders. Our total liability for any claim arising from your use of our service will not exceed the amount you paid us for the relevant order (or, if the claim is not tied to a specific order, $100).
Some jurisdictions don't allow these limits, and if you live somewhere like that, our liability is limited to the smallest amount permitted by law.
Nothing in these Terms limits liability for fraud, gross negligence, or anything else that cannot be limited by law.
12. Termination
You can stop using the service at any time. We can suspend or terminate your account if you materially violate these Terms, if your account is inactive for a long period, or if we stop offering the service. We'll give you reasonable notice where possible.
13. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Any dispute that can't be resolved informally will be brought in the state or federal courts located in Los Angeles County, California, and you consent to the jurisdiction of those courts.
(Optional arbitration clause — remove if your attorney advises against. We both agree to first try to resolve any dispute informally by contacting us at hello@bajaorganica.food. If we can't resolve it within 60 days, either party may elect binding individual arbitration under the rules of a reputable arbitration provider. Neither party waives the right to seek injunctive relief in court to protect intellectual property or confidential information. No class arbitration.)
14. Changes to these Terms
We may update these Terms occasionally. When we do, we'll change the "Effective date" at the top. If the changes are material, we'll make reasonable efforts to notify you — typically by email or a site banner. Continuing to use the service after we post updated Terms means you accept the new Terms.
